TERMS OF SERVICE AND PRIVACY
POLICIES SPECIFIC TO OCULUS ACCOUNT USERS
Hello and welcome to the Oculus Video App ("App") which is provided to you by Oculus VR, LLC, 1 Hacker Way, Menlo Park, California, USA ("Oculus," "we," "us" or "our"). These terms and the Oculus Terms of Service (https://www.oculus.com/legal/terms-of-service/) form your agreement with us ("Terms") as to the extent of your rights to use, view and download Licensed Content (as defined below). Please read the Terms carefully before purchasing a license to any Licensed Content (as defined below). If you do not agree to the Terms then you may not download or access content.
Our services are designed to enable you to stream and/or download digital content for your own personal non-commercial use. You are not permitted to share the service with any third party other than as expressly permitted in these Terms.
You must register and log in to your Oculus account in order to access and purchase a license to any content or other items via the App. Once logged in, our service may allow you to: (a) rent content for viewing over a limited period of time ("Rental Content"), (b) purchase a licensed to content for viewing over an indefinite period of time ("Purchased Content"), and (c) access content without charge for viewing over a limited period of time ("Free Content"). Content may be available on the service as Rental Content, Purchased Content or Free Content, or any combination of those ("Licensed Content"). The basis on which Licensed Content is available on the service will be indicated on the product page. From time to time, we may add or remove content from the service and may change the basis on which Licensed Content is available on the service.
The price for any Licensed Content will be as given on the App at the time you place an order for that Licensed Content. We use our best efforts to ensure that the prices for all Licensed Content are correct. Unfortunately errors do occur. If we discover an error in any price of Licensed Content purchased by you but not yet downloaded or streamed we will contact you to inform you of this error and we will give you the option of continuing to purchase the Product at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled.
Payment will be made via the payment method provided in your Oculus account or by one of the payment methods stated in the App. By providing details of a payment card or online account to be billed you confirm that you are authorized to purchase the digital items and that you are the holder of the card or are authorized to use it.
When you click "Buy" or "Rent" you are consenting to purchase a license to access that content. You can access that content immediately or you can download to your Oculus device at a later date. As soon as you download any Licensed Content to your Oculus Device your right to cancel and to request a refund will be lost.
Either you or we may cancel a pre-order for Purchased Content any time prior to the date of release of the Purchased Content.
In respect of Rental Content we grant you a non-exclusive, non-transferable, non-sublicensable, revocable limited license to view such content during the stated viewing period in accordance with these Terms. In respect of Purchased Content, we grant you a non-exclusive, non-transferrable, limited license to download, stream and view such content, and in the case of downloads, keep such downloads for an indefinite period of time, in each case in accordance with these Terms. In respect of Free Content, we grant you a non-exclusive, non-transferable, non-sublicensable, revocable limited license to view such content during the stated viewing period in accordance with these Terms.
Save for the foregoing limited license, no right, title or interest in any streamed or downloaded content or the intellectual property in or relating to the content shall be deemed transferred to you, and there shall be only a limited license and not a sale with respect to such content. You are prohibited from selling, renting, leasing, distributing, broadcasting, sublicensing or otherwise assigning any portion of any Licensed Content and/or any rights or license associated with any Licensed Content (including without limitation, any code or credentials that allow access to any Licensed Content. Save to the extent prohibited by applicable law, you shall not circumvent or remove, alter, deactivate or degrade any of the content protections in the App, the service or Oculus Device.
At any given time, except for Virtual Living Room Viewing (described below), you may view Licensed Content on no more than one (1) authorized Oculus device using the Oculus account you used for the purchase.
"Virtual Living Room Viewing" allows you to invite no more than five (5) VLR Guests to concurrently view Licensed Content via Oculus devices. "VLR Guest" means a third party individual who has a valid Oculus Customer Account. An online connection is required to use this service.
When using Virtual Living Room Viewing you may not permit any VLR Guest to initiate viewing or control the viewing experience in any way. You must ensure that all VLR Guests comply with these Terms.
We may perform a geolocation check on the VLR Guest prior to allowing the VLR Guest to engage in Virtual Living Room Viewing.
Licensed Content can be downloaded in the United States only. We or our third party service providers may use technologies to verify your location.
In the event of your breach of these Terms we will be entitled to terminate your use of and access to Licensed Content.
You may be charged by your network provider for data services or any other third party charges as may arise while using certain features of the App and/or Licensed Content and you accept responsibility for such charges. If you are not the bill payer for the services provided by the network being used to access the App and/or Licensed content, we will assume that you have received permission from the bill payer.
The laws of the State of California, excluding its conflicts of law rules, govern your access to and use of the App, services and Licensed Content.
